Terms of Service

These terms govern your use of the lossrunreports.com service, including subscriptions, billing, acceptable use and the limits of our liability.

Effective date. October 12, 2026

Agreement

These Terms of Service ("Terms") are an agreement between you and the administrator of the lossrunreports.com service ("we", "us"). By creating an account, starting a subscription or using the service, you accept these Terms. If you use the service for an agency or other organization, you confirm that you can bind it, and "you" means that organization. Questions go to [email protected].

The service

LossRunReports is software for requesting, tracking, receiving, reading and analyzing insurance loss runs and preparing submissions. Features and limits depend on your plan, as shown on the pricing page. The public demo lets a visitor read one sample or uploaded loss run once without an account. It is not a plan.

Accounts

You must give accurate information, keep sign-in credentials confidential and tell us promptly of any unauthorized use. You are responsible for activity under your accounts and for the users you invite and the roles you give them.

Subscriptions and billing

  • Plans are subscriptions billed in advance, monthly or yearly. Yearly billing is offered at a discount shown at checkout.
  • Subscriptions renew automatically for the same period until cancelled. We charge the payment method on file at each renewal.
  • Each plan includes monthly limits on client accounts, documents and seats. Usage counts when it happens, and deleting a document does not restore the limit. Limits reset at the start of each monthly period.
  • Upgrading to a higher plan or from monthly to yearly billing takes effect when the prorated difference is paid. Downgrades take effect at the next renewal.
  • Prices exclude taxes, which are added where required. We may change prices for future periods with at least 30 days' notice. The new price applies from your next renewal after the notice period.

Cancellation and refunds

You can cancel at any time from the billing settings. Cancellation takes effect at the end of the current paid period, and you keep access until then. We do not refund partial periods or unused limits, except where a refund is required by law.

We may suspend or end your access if payment fails and is not resolved, or if you materially breach these Terms. Where possible we give notice first.

Authorization to request loss runs

You are solely responsible for having the insured's authorization before you request loss runs or other information about that insured, including a valid letter of authority where you are not the agent of record. You are responsible for the accuracy of the client data, carrier details and letters you send through the service, and for complying with the laws, carrier requirements and contracts that apply to your requests. The service sends requests on your instructions and in your name.

Your content

You keep all rights in the documents and data you upload or receive through the service ("Customer Content"). You give us permission to host, copy, process and transmit Customer Content only as needed to provide the service to you, as described in the Data Processing Agreement, which forms part of these Terms. We do not use Customer Content to train AI models.

You confirm that you have the rights and notices needed to upload Customer Content, including any personal data of insureds and claimants.

Acceptable use

You will not:

  • request loss runs or other records without the insured's authorization, or impersonate an insured, agent or carrier,
  • use the service to send unsolicited messages or messages unrelated to insurance records,
  • upload malicious code or content you have no right to process,
  • attempt to access other customers' data, probe or bypass security, or overload the service,
  • resell the service, or copy or reverse engineer it except where the law allows,
  • use outputs to make automated decisions about individuals without the human review the law requires.

Outputs and professional judgment

Extracted claims, summaries, loss ratios, scores and narratives are produced from the documents you provide and can contain errors, especially from poor scans or inconsistent carrier reports. Review outputs before relying on them. The service does not give insurance, legal or underwriting advice, and decisions remain yours.

Third-party services

Integrations with AMS, CRM and other systems you connect are governed by your agreements with those providers. We are not responsible for their availability or for data once it leaves the service at your direction.

Disclaimer

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error free, or that carriers will respond to requests.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, commissions, business or data, even if advised of their possibility. Our total liability for all claims relating to the service is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim. These limits do not apply where the law does not allow them.

Indemnity

You will defend and indemnify us against third-party claims arising from your Customer Content, from requests you send without proper authorization, or from your breach of these Terms or applicable law.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Disputes arising from these Terms or the service are resolved in the state or federal courts located in Delaware, and both parties consent to their jurisdiction. Nothing in this section limits rights you have under mandatory consumer or data protection law where you live.

Changes to these Terms

We may update these Terms. Material changes are announced by email or in the service at least 30 days before they take effect. Continuing to use the service after that date means you accept the updated Terms. If you do not accept them, you can cancel before they take effect.

General

If any part of these Terms is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. These Terms, the Privacy Policy and the DPA are the entire agreement about the service.
